Lauren Brier, associate attorney at the Federal Practice Group, discusses how the bid protests against the JEDI contract selection process are faring, and how post-award protests might play out.


Oracle’s protest bid regarding the Joint Enterprise Defense Infrastructure cloud contract has a huge milestone coming up. The Government Accountability Office must decide the results of the protest by November 14.. IBM joined Oracle’s protest against the contract’s selection process in early October, additionally criticizing JEDI’s single source nature. According to Lauren Brier, associate attorney at the Federal Practice Group, the likelihood that these pre-award protests will prove successful is very slim.   “I think that the pre‑award protest is likely to be denied. It will move through proposals and post-award protests will follow. It is very dependent on how the government evaluates those proposals to see how the protest turns out,” Brier said. “The concerns that they have among the other industry leaders… For the tech industry, they thrive on collaboration and innovation. By limiting the award to only one contractor, it’s limiting the best value the government can take over.”
